dismayed at
detailed SC
judgement
LARKANA: The District Bar Association Larkana Wednesday passed a resolution expressing its dismay at the detailed judgement of the Supreme Court of Pakistan.
The Bar passed the resolution unanimously at a meeting of its managing committee held under the chairmanship of LBA President Asif Ali Soomro. Later the resolution was put before the general body of the bar and carried unanimously.
Later the LBA released the text of the resolution to the press later today.
The resolution said that SC's detailed judgement has eroded the dignity and legitimacy of the Superior courts.
It observed that judgement is in conflict with the short order dated 20-3-1996 which did not discriminate between the judges appointed under a democratic government and those appointed by the Chief Martial Law Administrator. It is a selecting approach, which is contrary to Article 25 of the Constitution which prohibits discrimination.
It said the judgement violates the basic principles of natural justice that no one should be a judge of his own cause. Moreover, by applying the test to judge appointed by a legitimae democratic government and indiscriminating themselves from the same principle, the judges have shown themselves to be self-serving.
It is indeed shocking that the judgement has made traversity of the principles of justice and equality before law.-APP
