RECORDER REPORT

LAHORE: A local civil judge while observing that as there was no way of recovery of decretal amount of Rs 4.6 million from Ch Manzoor Elahi father of acting opposition leader in the Punjab Assembly Ch Parvez Elahi, so he be arrested and sent to the district jail.

The civil judge ordered that Manzoor Elahi be produced before the court on September 5. It is also ordered that he be released on paying the decretal amount.

The proceedings against Chaudhry Manzoor were initiated on a suit for recovery of money filed by one Muhammad Saleem Cheema resident of Lahore. This suit was decreed and Chaudhry Manzoor was directed to pay the said amount. The approached the court for execution of the decree. The court ordered to auction the attached property for recovery of the amount.

Earlier the judge ordered for auction of three business concerns of the respondents, namely, M/s Ceeba Industries Ravi Road, Modern Flour Mills, Decora Carpet Industries Limited and even the houses situated at the Zahoor Elahi Road, Gulberg, Lahore, where they were currently residing. After these declarations, the wife of Chaudhry Manzoor Elahi filed an application stating that the houses were owned by her and could not be subjected to auction.

While filing an appeal against the auction of three industrial units, Ch Manzoor took the plea that the attachment of this property could not be carried out as these were not exclusively owned by him. He submitted that his share ought to be determined in these units prior to any auction in this regard.

Mohammad Akbar Tarar, advocate, on behalf of the applicant submitted that Manzoor Elahi during the co-operative scam got a loan of Rs 4.6 million from Cheema, the applicant which he promised to return within a few months. Later Chaudhry Manzoor also issued three cheques for the payments of these amounts. The cheques were dishonoured and when he contacted Chaudhry Manzoor Elahi for return of the amount, the later refused to pay back the money.
