Subject:-   FURNISHING OF INDEMNITY BOND UNDER SRO 987(I)/99, DATED 30.08.1999.

                Under condition 2(4) of
SRO 987(I)/99, dated 30.08.1999 an importer or purchaser of locally manufactured machinery is required to submit an indemnity bond to the extent of sales tax exemption available under the notification.


2.             A question has arisen that in cases where the supplier and the purchaser are located in different Collectorates, to which Collectorate the requisite Indemnity Bond is to be submitted by the purchaser?. The issue has been examined in the Board and it is clarified that since the Indemnity Bond is furnished in lieu of tax levied and payable on the machinery supplied, therefore, the Indemnity Bond duly supported by an attested copy of Sales Tax Registration is to be submitted by the purchaser to the Collector of Sales Tax, in whose jurisdiction the local supplier is located and in case of import, to the Collector of Customs in whose jurisdiction the goods are being cleared.
