The words, "not inconsistent with the provisions of
this Act" are not to be connected with the clause "nor any usage or custom of
trade." In the section as cited by the Privy Council there is no comma after
"contract" [(1891) 18 I.A. 121, at p. 127. ]
Note: (1) The chapter and sections of the Transfer of Property Act 1882 which relate to
contracts are in place in which that Act is m force, to be taken as part of this Act.
(2) This Act has been declared to be in force in Baluchistan [British Baluchistan Laws
Regulation, 1913]
(3) It has been applied to Phulera in the excluded area of Upper Tanawal to the extent the
Act is applicable in the NWFP, subject to certain modifications; and extended to the
Excluded area of Upper Tanawal (NWFP) other than Phulera w.e.f. such date and subject to
such modifications as may be notified [NWFP (Upper Tanawal) (Excluded Area) Laws
Regulation, 1950]
(4) This Act has been extended to the Leased Areas of Baluchistan [Leased Area (Laws)
Order, 1950]
